Welcome to Ayna! These Terms of Use ("Terms") govern your access to and use of the Ayna mobile application and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Ayna, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Ayna is a vision board application that uses artificial intelligence to generate personalized images depicting you achieving your goals. The Service includes:

• AI-powered image generation based on your photos and goals
• Personalized vision board creation and management
• Goal tracking and progress monitoring
• Motivational reminders and notifications
• Cloud storage for your generated content

3. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

4.1 Account Creation

• You may create an account using Google Sign-In, Apple Sign-In, or other supported methods
• You must provide accurate, current, and complete information
• You are responsible for maintaining the security of your account credentials

4.2 Account Responsibility

• You are solely responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage arising from unauthorized account access

5. Subscription and Payment

5.1 Subscription Plans

• Ayna offers an annual subscription plan at $29.99/year (pricing subject to change)
• Subscriptions automatically renew unless canceled before the renewal date
• Payment is charged to your App Store or Google Play account

5.2 Cancellation

• You may cancel your subscription at any time through your App Store or Google Play account settings
• Upon cancellation, you will retain access to premium features until the end of your current billing period
• No refunds are provided for partial subscription periods

5.3 Free Trial

• We may offer free trials for new users
• Your subscription will automatically begin at the end of the trial period unless canceled
• We reserve the right to modify or discontinue free trial offers at any time

6. User Content and Photos

6.1 Your Content

• You retain all rights to the photos and content you upload to Ayna
• By uploading content, you grant Ayna a worldwide, non-exclusive license to use, process, and display your content solely for the purpose of providing the Service

6.2 Content Requirements

• You may only upload photos of yourself
• You may not upload photos that violate intellectual property rights, privacy rights, or are illegal
• You may not upload offensive, harmful, or inappropriate content

6.3 Generated Images

• Images generated by Ayna's AI are provided for your personal use
• Generated images are based on your photos and should not be used to misrepresent or deceive others
• You may not use generated images for commercial purposes without our written consent

7. Acceptable Use

7.1 Prohibited Uses

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate the rights of others, including privacy, publicity, or intellectual property rights
• Upload or transmit viruses, malware, or other harmful code
• Attempt to reverse engineer, decompile, or hack the Service
• Use automated systems (bots, scrapers) to access the Service
• Impersonate others or create fake accounts
• Harass, abuse, or harm others
• Use the Service to generate misleading or deceptive content

7.2 Content Moderation

• We reserve the right to review and remove content that violates these Terms
• We may suspend or terminate accounts that engage in prohibited activities
• We are not responsible for user-generated content

8. AI and Image Generation

8.1 AI Technology

• Ayna uses artificial intelligence to generate images
• AI-generated images are approximations and may not be perfectly accurate
• We do not guarantee the quality, accuracy, or suitability of generated images

8.2 Responsible Use

• Generated images should be used responsibly and ethically
• You may not use generated images to deceive, defraud, or mislead others
• You may not use the Service to create harmful, offensive, or illegal content

9. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Intellectual Property

10.1 Our Rights

• Ayna, its logo, and all related trademarks are owned by us
• The Service, including its software, design, and functionality, is protected by copyright and other intellectual property laws
• You may not copy, modify, or distribute any part of the Service without our permission

10.2 Your Rights

• You retain ownership of all photos and content you upload
• We do not claim ownership of your generated images

11. Third-Party Services

The Service may integrate with or link to third-party services (e.g., Apple, Google, Firebase). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.

12. Disclaimers

12.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 No Guarantee

• We do not guarantee that the Service will be uninterrupted, error-free, or secure
• We do not guarantee the accuracy, reliability, or quality of AI-generated content
• Use of the Service is at your own risk

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AYNA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use of or inability to use the Service
• Unauthorized access to your content or account
• Any conduct of third parties on the Service
• Any generated images or content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.

14. Indemnification

You agree to indemnify, defend, and hold harmless Ayna and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of others
• Your uploaded content or generated images

15. Modifications to Service and Terms

15.1 Service Changes

• We reserve the right to modify, suspend, or discontinue the Service at any time
• We may add or remove features, change pricing, or alter functionality
• We will provide notice of material changes when feasible

15.2 Terms Changes

• We may update these Terms from time to time
• Continued use of the Service after changes constitutes acceptance of the new Terms
• We will notify you of significant changes via the app or email

16. Termination

16.1 By You

• You may terminate your account at any time through the app settings
• Upon termination, your access to premium features will end at the conclusion of your current billing period

16.2 By Us

• We may suspend or terminate your account for violations of these Terms
• We may terminate accounts that are inactive for extended periods
• Upon termination, we may delete your content in accordance with our Privacy Policy

17. Governing Law and Disputes

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

17.2 Dispute Resolution

• Any disputes arising from these Terms shall be resolved through binding arbitration
• You waive your right to participate in class action lawsuits
• Arbitration shall be conducted in accordance with the American Arbitration Association rules

17.3 Exceptions

You may bring claims in small claims court if they qualify. Additionally, either party may seek injunctive relief in court for intellectual property infringement.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ayna.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.
